I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE <br /> <br />IMPLEMENTATION OF CHAPTER 8 OF THE CHARTER <br /> By: Ryan R. Schroeder, City Administrator <br /> <br />Background: <br /> <br />At the meetings of October 22, November 12, and December 10, 1996, Council discussed <br />adoption of an ordinance implementing the specifics of the general terms of the <br />referendum adopted Chapter 8 of the Ramsey City Charter, After the December public <br />hearing, the ordinance was tabled. Attached for your review is a revised ordinance. <br /> <br />When last this was discussed, there was a proposed resolution attached which, following <br />ordinance adoption, would levy a utility charge against three households within the <br />community which have access to municipal utilities but which have exercised their <br />options under Chapter 8. The result is that the benefited properties do not have to <br />connect to the system. As a result, it had been proposed that the minimum utility charge <br />be billed in this situation as a result of availability of the utilities. This connection charge <br />created a significant amount of confusion throughout the community among residents <br />thinking they would be subject to the charge (even though it would effect only three <br />properties). As a result of this confusion we are recommending that that proposed charge <br />be dropped. <br /> <br />The original ordinance draft required connection to municipal utilities upon sale or <br />transfer of title. We are recommending by the attached ordinance that this also be <br />dropped. <br /> <br />The repair of systems and definition sections of the ordinance have both been reworked. <br />The result is that nonfunctioning systems are as defined by the Pollution Control Agency <br />or state statute as nonfunctioning systems. Relative to wells, you may wish to add to <br />Section 3 subdivision 2 ",the state plumbing code, or regulations of the Minnesota <br />Department of Health" at the end of the subdivision.
