Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #97-05- RESOLUTION AUTHORIZING RELEASE OF COVENANT REGARDING USE OF BISON STREET WHEREAS, by a Court Order and Stipulation dated June 4, 1982, the City agreed with reference to Bison Street as follows: "... contemporaneously with any relocation of the roadway, that it (City) shall take the necessary legal proceedings to vacate the encroaching portion of the roadway as a public road, said proceedings to be at no direct cost to Applicants, and to effectuate a conveyance thereof to the Applicants." AND WHEREAS, the above provision is a memorial on the Certificate of Title of an adjacent property; and WHEREAS, the adjacent property owner has requested that the City act to release its interest in the adjacent property by an appropriate release document; and WHEREAS, the Anoka County Examiner of Titles Office has recommended the correct language for the City to use in granting the release. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1. That the City hereby authorizes its Mayor and City Administrator to execute on behalf of the City a Release containing the following language: "The Registrar of Titles of Anoka County is accordingly authorized and directed by the filing of this Release to omit from future Certificates of Title the recital of the covenant regarding the use of Bison Street, as set forth in Stipulation dated June 4, 1982 and filed June 16, 1982 in Torrens Case No. T-2562."
