I <br /> ! <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR A SEASONAL OUTDOOR <br />RECREATIONAL FACILITY; CASE OF HOLM'S SUPER BOWL, INC. <br /> By: Zoning Administrator Sylvia Frolik <br /> <br />Background: <br /> <br />The City has received an application for a conditional use permit from Mr. Holm to establish <br />four volleyball courts and an outdoor bar area on the west side of the Super Bowl structure <br />located at 6720 Highway #10 NW. <br /> <br />Observations: <br /> <br />The applicant is proposing to eliminate the two existing volleyball courts on the east side of the <br />building and relocate this activity to the west side and increase the number of courts from two to <br />four. The operation of the existing volleyball courts on the east side of the structure was <br />permitted to occur without benefit of a conditional use permit as an extension of the indoor <br />commercial recreational use. The City has on occasion received complaints regarding <br />trespassing onto adjacent residential parcels and noise as a result of the volleyball activities. <br />Therefore, when the applicant approached the City regarding relocating the courts to the west <br />side and increasing the number of courts, it was determined by City Staff that a conditional use <br />permit would be appropriate. <br /> <br />The applicant has stated that the establishment of these courts on the west side of the building <br />will not deplete the amount of existing off-street parking spaces on the site. <br /> <br />The surrounding parcels to the east, west, and north, and the parcel immediately adjacent on the <br />southwest side of the subject property is currently zoned commercial. The parcel immediately <br />adjacent on the southeast side of the subject property is zoned residential. <br /> <br />The applicant has submitted a site plan that proposes to encompass the entire volleyball court <br />area in chain link fence. This chain link fence would be established approximately one foot in <br />from the common property line with the adjacent parcel to the southwest. The actual courts <br />themselves are set back 20 feet from this common property line. In addition, Mr. Holm has <br />entered into a purchase agreement'with Mr. Williams, the owner of the adjacent parcel to the <br />southwest, to acquire an additional 60 feet of property. This transaction will result in an 80-foot <br />buffer between the courts and the newly aligned common property line with the parcel to the <br />southwest. Mr. Williams is contemplating rezoning the remainder of the southwest parcel to <br />residential if Mr. Holm doesn't exercise his option to buy the rest of the parcel. <br /> <br />The applicant has proposed to plant some trees along Ebony Street. City Code does not require <br />screening in this area, but it does require a 20-foot-wide landscaped area along the road. The <br />width of this landscaped area on the Super Bowl site is proposed to be 15 feet and will be located <br />between the chain link fence and the courts.
