Goodrich, City Attorney <br /> <br />I <br />I <br />I <br />I <br /> <br />Background: <br /> <br />On April 22, 1997 the Council tabled action on acquisition of a 39 <br />foot wide parcel of land for the right of way to construct a <br />segment of Llama street lying south of Highway 10. The delay was <br />to allow for negotiations between the Alpaca Partnership and Joe <br />Nathe, owner of the 39 foot strip. <br /> <br />I met with the parties on Wednesday, April 30th~ At that time, the <br />Alpaca Partnership made an offer to purchase the right of way, <br />which offer was subsequently rejected by Mr. Nathe. To date Mr. <br />Nathe has not made a counter offer. <br /> <br />The enclosed May 16, 1997 letter from the Shorewood RV's attorney <br />threatens legal action against the City and the Alpaca Partnership <br />if their access issue is not resolved immediately. <br /> <br />I <br />I <br />I <br /> <br />Observation: <br /> <br />City staff believes a safety issue as well as transportation <br />planning issue does exist in the event Riverdale Drive dead ends at <br />the Shorewood RV site as this will result in an approximately 2,289 <br />foot cul de sac at the westerly end of Riverdale Drive. It should <br />be noted that this area is not served by City water and fire <br />vehicles and other emergency vehicles would, of course, require use <br />of this single access street. <br /> <br />Recommendation: <br /> <br />It is staff's recommendation that the City Council adopt a <br />resolution authorizing the initiation of eminent domain <br />proceedings. Since the direct benefit of this action will be to <br />the Alpaca Estates 4th Addition subdivision, cost associated with <br />the eminent domain proceedings should be charged against that <br />subdivision escrow. Negotiations between the parties can still <br />continue while the condemnation process proceeds. <br /> <br />Motion to adopt Resolution #97-05-XXX authorizing eminent domain <br />proceedings for the property required to improve Llama Street <br />between T.H. #10 and Riverdale Drive. <br /> <br />Reviewed by: <br /> <br />City Engineer <br />City Administrator <br />Finance Officer <br /> <br /> <br />
