Councilmember <br />moved for its adoption: <br /> <br />introduced the following resolution and <br /> <br />RESOLUTION 997-05- <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF A PERMANENT EASEMENT FOR CITY <br />STREET AND UTILITY PURPOSES. <br /> <br /> WHEREAS, the city finds it necessary to construct an extension <br />of Llama Street south of U.S. Highway 10 (the "Street Improvement <br />Project"); and <br /> <br /> WHEREAS, a permanent easement over, under and across certain <br />real property is required to provide for the construction of the <br />Street Improvement Project and in order to further the public <br />health, safety and convenience of the residents of the city; and <br /> <br /> WHEREAS, the city has authority to acquire a permanent <br />easement for the Street Improvement Project by eminent domain <br />pursuant to the City Charter and Minn. Stat. Chapter 117; and <br /> <br /> WHEREAS, the City has the right to acquire the permanent <br />easement prior to the filing of an award by the Court appointed <br />commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and <br /> <br /> WHEREAS, the property owner of the real property over which <br />the permanent easement needs to be acquired, upon information and <br />belief, has been identified by the City as follows: <br /> <br />PIN <br /> <br />29-32-25-13-0002 <br /> <br />FEE OWNER <br /> <br />Joseph H. Nathe <br /> <br />REAl' PROPERTY DESCRIPTION <br /> <br />All that part of the West 2 rods and 6 feet of the <br />Southwest Quarter of Northeast Quarter of Section <br />29, Township 32, Range 25 lying and being south <br />of Trunk Highway No. 10, formerly known as U.S. <br />Military Road <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTwA, as follows: <br /> <br />That the City Administrator is hereby directed to acquire a <br />permanent easement for street and utility purposes over, under <br />and across the real property as described above in accordance <br />with Minnesota Statutes.
