CASE # <br />PUBLIC HEARING AND REQUEST FOR VACATION OF EASEMENT <br /> IN R.A. PELTZER ADDITION; <br /> CASE OF RAMSEY TOWN CENTER LLC <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />As part of tonight's agenda, the City Council is reviewing the proposed final plat for Town <br />Center. Part of the process includes vacating existing underlying easements. These easements <br />will be replaced as necessary as each of the outlots are replatted and developed. Ramsey Town <br />Center has requested that the City vacate the drainage and utility easement around the perimeter <br />of Lot 1, Block 1, R.A. Peltzer Addition. The following items are enclosed for your information: <br /> <br />a) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated- <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />As a result of the public hearing notices that were sent out, City Staff did receive a telephone call <br />from a representative of the right-of-way engineering department at Cormexus. Aparently there <br />are some underground and overhead utilities adjacent to County Road #56 and County Road <br />#116. Although the plan would be to eventually replace the easements as development occurs, in <br />this case Staff is of the opinion tha~ these particular easements should not be vacated at this time. <br />When there is a specific plan proposed for this area of the town center; the underlying easements <br />can be vacated simulatenously with the replatting and replacement of easements. <br /> <br />Recommendation: <br /> <br />City Staff recommends denying the request to vacate these easements at this time and directing <br />the developer to reapply for easement vacation when there is a specific plat and site plan for the <br />subject property. <br /> <br />Council Action: <br /> <br />Motion to deny the request to vacate the-drainage and utility easements along the perimeter of <br />Lot 1, Block 1, R.A.
