The home on the property was constructed in the very early 1900's and the
Edgerton's are proposing to demolish the home and construct a new home on the property. They
would like to live in the existing home while the new one is being constructed. In accordance
with City Code, the City should not issue a building permit for a home on a property that already
has a dwelling. The Edgerton's were advised to apply for an Interim Use Permit that would
enable City Staff to issue a building permit for a second home on the property.

The following items are enclosed for your information:

a)
b)
c)
d)
e)

Site location map
Site Plan
New home floor plan
Proposed findings of fact
Proposed conditional use permit

Notification:

In accordance with State statute, City Staff attempted to notify all owners of property with/n 350
feet of the Subject Property of the request for Interim Use Permit and public hearing.

Observations:

The Subject Property is approximately 5 acres in size and is located in the RUral Preserve area of
the R-1 Residential District. The Applicants have stated that the home
has been inspected and no asbestos was found, lead paint levels were in an acceptable range, and
the contractor will be disposing of the mercury switch on the thermostat in accordance with
Minnesota Pollution Control Agency (MPCA) regulations.

The proposed permit is drafted to require that the new home be constructed within 6 months, that
the applicants take occupancy of the new home within 30 days of issuance of certificate of
occupancy, and the existing home be demolished and removed within 60 ~ays of the issuance of
certificate of occupancy for the new home.
