Goodrich, Ramsey city Attorney <br />Impact Fees <br />March 5, 1997 <br /> <br />As you requested, I am attaching two relatively recent memorandums <br />I have written to you regarding Impact Fees. For your information <br />the Country Joe v. city of Eagan lawsuit referenced in my August 5, <br />1996 memo was accepted for review by the Minnesota Supreme Court. <br />I contacted the Supreme Court recently and was advised that a <br />decision has been written and it is presently being circulated for <br />review by the various Justices. Of course, I do not know the <br />content of the decision, however, in discussion with a group of <br />other city attorneys the consensus seems to be that the Court of <br />Appeals will be upheld by the Supreme Court. That means that the <br />impact fees as Ramsey has been requiring will not be permitted.
