Councilmember introduced the following resolution_~d moved for its adoption: RESOLUTION #97-07-~,~-~ A RESOLUTION ADOPTING FINDING OF FACT # tJt-/'~;~LATING TO A REQUEST FROM THOMAS KURAK FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORTS SOILS WHEREAS, the City of Ramsey received an application from Thomas Kurak for a conditional use permit to grade and export excess soils from the property legally described as follows: The Southeast Quarter of the Southwest Quarter, Section 23, Township 32, Range 25, Anoka County, Minnesota. Together with that part of Government Lot 1 of said Section 23 lying easterly of the easterly line of the fight-of-way of County Road No. 57, also known as Sunfish Lake Boulevard, according to the duly recorded plat of ANOKA COUNTY HIGHWAY RIGHT-OF-WAY PLAT NO..1. Excepting from said Government Lot 1 all that part thereof described as commencing at a point on the south line of said Government Lot I a distance of 572.00 feet East of the southwest comer thereof; thence North 15 degrees 51 minutes 08 seconds East for 741.00 feet to a point to be hereafter known as Point "G" for the purposes of this description; thence South 89 degrees 21 minutes 08 seconds West parallel with said south line of Government Lot 1 for about 65.73 feet to intersect with the above described easterly line of fight-of-way of County Road No. 57, said point of intersection also being the actual point of beginning of the exception to be hereby described; thence return East to said Point "G"; thence South 26 degrees 38 minutes 52 seconds East for 366.00 feet; thence South 3 degrees 08 minutes 52 seconds East for about 381.89 feet to intersect said south line of Government Lot 1; thence South 89 degrees 21 minutes 08 seconds West along said south line of Government Lot 1 for about 646.17 feet to intersect with the above described easterly line of the right-of-way of County Road No. 57; thence northeasterly along said easterly line of the right-of-way of County Road No. 57 for about 856.05 feet to the point of beginning. For the purposes of this exception description, said south line of Government Lot 1 is assumed to bear North 89 degrees 21 minutes 08 seconds East. (the "Subject Property"). NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on March 11, 1997, Thomas Kurak, hereinafter referred to as "Applicant", applied for a conditional use permit to grade and export excess soils from the Subject Property.
