We have also reviewed the background information <br />available through the meeting minutes of the Planning Commission and City Council, <br />letters from residents, case presentations, and the Bolton & Menk Traffic Analysis. <br />We also contacted the Minnesota Natural Heritage Data System to ascertain the <br />significance of the biotic community on the parcel. <br /> <br />The proposed project is of a size which is neither exempt from nor which is mandated <br />to have an EAW prepared. It, thus, is the City's responsibility to determine whether <br />a discretionary EAW is needed. Nearby residents have petitioned for an EAW. <br /> <br />The City requested that we review the arguments and evidence presented to determine <br />whether the project has the potential for significant environmental effects. Based on <br />our review and discussion with DIVR personnel, it is our conclusion that there is not <br />sufficient evidence to determine that significant environmental effects could be <br />attributed to the proposed project. As such, the City need not order an EAW. We <br />have proposed findings which would support such a determination. <br /> <br />The City, however, is not precluded from ordering an EAW should there be concerns <br />that have not been addressed.
