We, thus, have relied many times on DOT's Order 5050.4A for reviewing <br />whether significant thresholds may be reached. A brief summary of the thresholds in <br />5050.4A for the arguments set forth in the petition is provided for your information. <br /> <br />Wetlands <br /> "A proposal is considered to affect wet/ands if it would involve development in <br />a wet/ands area; involve dredging, filling, draining, channelizing, diking, impounding, <br />or otherwise directly impact a wetlands area; involve disturbing the water tame of an <br />area in which a wet/and lies; or indirectly affect a wet/and by impacting regions <br />upstream or downstream or inducing secondary development." <br /> <br />With respect to indirect impacts, the effects on water quality, water supply and <br />recharge capability, interference with surface and subsurface water courses, siltation <br />and sedimentation, flood and storm hazards, and biotic community disruption are <br />usually addressed through the implementation of best management practices (BMP's) <br />and stormwater management requirements. Particular concerns would typically be <br />addressed in a developer's agreement. <br /> <br />Bioti~; Communities <br /> "/f the proposal would impact only man-dominated areas such as previously <br />disturbed property, populated areas or farm/and; it may be assumed that there would <br />be no significant impact on biotic communities. /f the proposal involves the removal <br />of a sizeable amount of habitat which supports rare species, or of a sma//, sensitive <br />tract but the accompanying loss of p/ant communities and development of wildlife do <br />not result in a significant long term loss to the area, it may be assumed that there <br />would be no significant impact on biotic communities. /nput from state and local <br />review and other informal coordination as .necessary is to be used to determine the <br />significance of the impacts." <br /> <br />Rare and Endangered Species or Threatened <br /> "/f no rare or endangered species are present, it may be assumed that there <br />would be no significant impact. /f endangered or threatened species may be present <br />in the area affected by the proposed action, a biological assessment shaft be prepared <br />to identify whether the species or critical habitat are likely to be affected by the action <br />and what those effects would be. /f the biological assessment indicates no adverse <br />effects on the species or critical habitat, it may be assumed that there would be no <br />significant impact." <br /> <br />Hakanson <br />Anderson <br />Assoc., Inc. <br /> <br /> <br />
