(,~12) 42J-4~13 Ryan Schroeder city Administrator 15153 Nowthen Boulevard NW Ramsey, Minnesota 55303 Re: Attorney Prosecution Services Dear Mr. Schroeder: We are enclosing pursuant to your request, our proposal for City legal services for the calendars year 1995 through 1997. We have attempted to formulate a proposal for prosecution services that includes a "not to exceed" clause in regards to total prosecution billings for 1995, 1996, and 1997. By this letter we would like to explain how we arrived at our proposal for prosecution services. Prosecutions have been increasing rapidly in the city. We assume this is due to the city's increasedpopulation and resulting additions to the police force. Since the'first year of our present contract in 1991, the police department has added one additional full time officer and we understand requests have been made for additional officers during the next three years as well. Additionally, the State legislature has continued to increase the number of gross misdemeanor offenses and has mandated strict arrest procedures involving domestic assaults which has also contributed to the need for additional municipal prosecution services. In 1992, total prosecution fees for the City were $27,167.15 with 452.5 hours of legal services expended. In 1993, total prosecution fees increased to $33,9~7.45 representing 547.5 hours of legal services. Based upon a review of the prosecution services provided through the first six months of 1994, another increase in the total actual prosecution hours is projected for 1994. Currently, the average prosecution billings for the first six months of 1994 have been $3,106.00 per month. This would project out to an annual prosecution fee Of $37,281..12 for 1994 representing 573.5 hours of legal services. As is apparent the "not to exceed" clause in the current contract has resulted in the actual fees received by our firm being considerably less than had we been paid for all hours actu~!ly I I ! !
