I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
I
!
I

Mr. Schroeder
Page 2
July 20, 1994

expended. This difference over the three year term of the current
contract will total approximately $17,000.00.

Ail indications are that required prosecution services for
1995 will increase at least 10% to 15% using the last three years
as a measurement. Additions to the police department and legis-
lative changes could result in even more substantial increases in
required prosecution services for the City. For example, we
believe Anoka County is going to require municipal prosecutors to
be present at all misdemeanor arraignments starting January 1,
1995. If in fact this occurs, prosecution hours will, or course,
increase as a result of this additional Court time.

It is difficult to project with any accuracy specific
prosecution needs two to three years into the future. However,
using the data currently available and reviewing the trends for the
last three years, we have projected the City's prosecution fees not
to exceed $42,000.00 for 1995. Using a conservative 10% growth
factor in the years thereafter, we have projected minimum
prosecution requirements of $46,200.00 for 1996 and $49,500.00 for
1997. We have therefore incorporated those figures into the "not
to exceed" paragraph of the letter agreement.

We recognize the increase in the "not to exceed" amount over
the previous three year contract, however, as these are "not to
exceed" figures the prosecution fees will, of course, be less if
we are presented with fewer matters to prosecute. As in the past,
we will continue to be diligent in keeping accurate hourly time
records in order to properly substantiate our billings.
We believe we have provided competent and efficient
prosectuion services to the City in the past and we will strive to
continue to improve this effort in the future.

Thank you very much for allowing us to present this proposal.
We will, of course, be available for any questions you may have on
this subject.

Sincerely,

Thomas M. Fitzpat~'~gC
