The Planning Commission proceeded to review the terms of the Interim Use Permit.

Motion by Commissioner Deemer and seconded by Commissioner LaDue to recommend that
City Council approve the request fi.om Transwest, Inc. for an Interim Use Permit for a temporary
structure, along with a recommendation for the construction of an earth berm (not to include
trees) across the north property boundary.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, LaDue, and
Thorud. Voting No: Commissioner Terry. Absent: Commissioners Holland and Jensen.

COMMISSION INPUT

Commissioner Deemer stated there has been difficulty getting the exterior lighting fixture
requirement checked off before the Building Department issues the Certificate of Occupancy to
buildings in the commercial districts. Because the State inspects the electrical, the Building
Department doesn't feel this is their responsibility to review and approve light fixtures. He
advised that many of the recent buildings sites approved do not meet code yet have been issued
Certificates of Occupancy.

Zoning Administrator Frolik agreed that with all the other issues to be addressed (landscaping,
drainage, etc.), the lighting plan seems to fall by the way side and isn't being brought to the City
Engineer for approval and the Building Official assumes that the lighting has been approved.

Motion by Commissioner Deemer and seconded by Commissioner Terry to direct the Building
Inspection Department to ensure the exterior lighting requirement in the commercial districts
meet City Code before issuing Certificate of Occupancy.

Further Discussion: Commissioner Deemer noted that Casey's doesn't meet Code. Ms. Frolik
inquired about Shorewood RV, and Commissioner Deemer stated they have not complied yet
either.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, LaDue, and
Thorud. Voting No: None. Absent: Commissioners Holland and Jensen.

ADJOURNMENT

Motion by Commissioner LaDue and seconded by. Commissioner Thorud to adjourn the meeting.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners LaDue, Thorud, Deemer,
and Terry. Voting No: None. Absent: Commissioners Holland and Jensen.

Planning Commission/July 14, 1997
