Goodrich, city Attorney <br /> <br />CASE NO. 5 <br /> <br />Background: <br /> <br />At a recent Council meeting the Council agreed to resolve Ms. <br />Farber's storm water drainage claim against the City by payment to <br />her of $2,000.00 in addition to certain drainage corrections in an <br />effort to direct storm water from her property. <br /> <br />Enclosed is an agreement prepared by Ms. Farber's attorney. Staff <br />generally is in agreement with the proposed agreement, however, <br />believes that certain wording and phrases should be revised to <br />better reflect the intent of the City. <br /> <br />Recommendation: <br /> <br />Staff recommends entering into an agreement with Ms. Farber <br />containing terms similar to those in the enclosed agreement, but <br />which contains revised language to protect the City from further <br />liability on this subject. <br /> <br />Council Action: <br /> <br />Motion to approve entering into an agreement regarding storm water <br />runoff with Ms. Laurie Farber for her property located at 6508 - <br />171st Lane NW, subject to approval of the legal termnology in the <br />agreement by the City Attorney. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />city Attorney <br /> <br /> <br />
