A~EEMENT i" <br /> THIS AGREEMENT is entered into this !~T~ day of ~, <br /> 1997, by and between LORI FARBER ("FARBER") and THE CITY OF RAMSEY. <br /> <br /> WHEREAS, Farber is the owner of property located at 6508 171st <br /> <br />Lane North West, city of Ramsey, county of Anoka, state of <br />Minnesota; and <br /> <br /> WHE WREAS, the city of Ramsey issued a building permit to TIM <br /> <br /> SMITH ("SMITH") allowing smith to develop property and build a <br /> <br />house on a hill to the immediate West of Farber's property; and <br /> <br /> WHEREAS, after Smith's home was built, Farber's property began <br />experiencing increased water runoff from Smith's property causing <br />Farber's property to flood and her sewer system to back up; and <br /> <br /> WHEREAS,. it is Farber's position that the city of Ramsey is <br />responsible for the flooding of her property by allowing Smith's <br />property to be developed without providing for an adequate drainage <br />system to handle the increased water runoff; and <br /> <br /> WHEREAS, the city of Ramsey acknowledges partial <br />responsibility for the flooding of Farber's property; and <br /> <br /> WHEREAS, the city of Ramsey also snow plows the street upon <br /> <br />which Farber's property lies and deposits said snow in a pile on <br /> <br />the Northwest corner of Farber's property; and <br /> <br /> WHEREAS, as a result of the snow being deposited on Farber's <br /> <br />property by the city of Ramsey, Farber experiences flooding of her <br />property during the spring thaw when said snow pile begins to melt; <br />and <br /> <br /> <br />
