Goodrich, city Attorney <br /> <br />Background= <br /> <br />The Council will recall that city staff has previously been <br />directed to work with the respective property owners in an effort <br />to acquire sufficient right-of-way for the construction of Llama <br />Street south of Highway 10 to Riverdale Drive. The landowner, Mr. <br />Nathe, and the developer, Alpaca Estates, have orally agreed to the <br />terms of a sale and purchase. The enclosed purchase agreement <br />reflects the terms of that preliminary agreement. Council should <br />note particularly the terms in the purchase agreement which relate <br />to the street name, the sign permit and the future improvement of <br />Llama Street south from Riverdale Drive. <br /> <br />Also enclosed is a proposed amendment to the Alpaca Estates 4th <br />Addition Development Agreement. This amendment requires the <br />Developer to deposit with the City funds necessary to purchase the <br />right-of-way from Mr. Nathe and an agreement to dedicate Outlot B, <br />Alpaca Estates 4th Addition for future Llama Street improvement. <br /> <br />Recommendation: <br /> <br />City staff recommends entering into both of the enclosed <br />agreements. <br /> <br />Council Action: <br /> <br />Motion to authorize the Mayor and City Administrator to execute on <br />behalf of the city the purchase agreement with Joseph H. Nathe and <br /> , husband and wife for the acquisition of <br />a 39 foot wide strip of land lying south of Highway 10. <br /> <br />Motion to authorize the Mayor and city Administrator to execute on <br />behalf of the City the amendment to the Alpaca Estates 4th Addition <br />Development Agreement which amendment requires the Developer to <br />escrow with the City the cash funds necessary to purchase the Llama <br />Street right-of-way necessary to extend Llama Street south of <br />Highway 10. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />City Engineer <br />city Zoning Officer <br /> <br /> <br />
