I I I I I I I ,I I I I I I I I I I I I ACQUISITION OF LLAMA STREET RIGHT-OF-WAY SOUTH OF HIGHWAY 10 CASE NO. By: Wi11iam K. Goodrich, city Attorney Background= The Council will recall that city staff has previously been directed to work with the respective property owners in an effort to acquire sufficient right-of-way for the construction of Llama Street south of Highway 10 to Riverdale Drive. The landowner, Mr. Nathe, and the developer, Alpaca Estates, have orally agreed to the terms of a sale and purchase. The enclosed purchase agreement reflects the terms of that preliminary agreement. Council should note particularly the terms in the purchase agreement which relate to the street name, the sign permit and the future improvement of Llama Street south from Riverdale Drive. Also enclosed is a proposed amendment to the Alpaca Estates 4th Addition Development Agreement. This amendment requires the Developer to deposit with the City funds necessary to purchase the right-of-way from Mr. Nathe and an agreement to dedicate Outlot B, Alpaca Estates 4th Addition for future Llama Street improvement. Recommendation: City staff recommends entering into both of the enclosed agreements. Council Action: Motion to authorize the Mayor and City Administrator to execute on behalf of the city the purchase agreement with Joseph H. Nathe and , husband and wife for the acquisition of a 39 foot wide strip of land lying south of Highway 10. Motion to authorize the Mayor and city Administrator to execute on behalf of the City the amendment to the Alpaca Estates 4th Addition Development Agreement which amendment requires the Developer to escrow with the City the cash funds necessary to purchase the Llama Street right-of-way necessary to extend Llama Street south of Highway 10.
