'1 <br /> I <br /> <br /> I <br /> I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> to provide that the DEVELOPER will dedicate to the CITY for street <br /> and utility purposes Outlot B, ALPACA ESTATES 4TH ADDITION. <br /> <br /> NOW, THEREFORE the CITY and DEVELOPER agree to amend the <br />Development Agreement as follows: <br /> <br /> 1. The DEVELOPER will escrow with the CITY the sum of <br /> $40,000.00 which sum will be used by the CITY to purchase the <br /> following described parcel of land, to-wit: <br /> <br /> All the part of the West 2 rods and 6 feet of the <br /> Southwest Quarter of Northeast Quarter of Section 29, <br /> Township 32, Range 25 lying and being south of Trunk <br /> Highway No. 10, formerly known as U.S. Military Road, <br /> Anoka County, Minnesota; <br /> <br />the "Right-of-Way". <br /> <br /> 2. The DEVELOPER agrees to deposit with the CITY such <br />further sum(s) not to exceed $1,000.00, which amount the CITY <br />reasonably believes will be necessary to defray the CITY,S expenses <br />in closing on the transaction to purchase the right-of-way. Any <br />sums not used by the CITY directly related to the right-of-way <br />closing will be promptly remitted to the DEVELOPER. <br /> <br /> 3. The DEVELOPER will convey to the CITY, on an appropriate <br />instrument drafted by the CITY, a permanent easement for street and <br />utility purposes over, under and across Outlot B, ALPACA ESTATES <br />4TH ADDITION. <br /> <br /> Except as above modified and agreed to, all the terms and <br />conditions of the Development Agreement shall remain in force and <br />binding on the parties hereto. <br /> <br /> <br />
