Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #97-08- RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR WATER WELL PURPOSES WHEREAS, the City finds it necessary to add capacity to its existing municipal water utility system; and WHEREAS, a new water well (the "Public Improvement") is necessary to accomplish this additional capacity requirement; and WHEREAS, the City finds it necessary to acquire fee title to certain real property in order to provide property for the construction of the water well; and WHEREAS, the City has the right to acquire the real property for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter 117; and WHEREAS, the City has the fight to acquire the real property prior to filing of an award by the Court Appointed Commissioners, pursuant to Minn. Stats. §117.011 and §I 17.042; and WHEREAS, the property owner of the real property which needs to be acquired has been identified by the City as follows: PIN Part of 28-32-25-11-0006 FEE OWNER The Menkveld Co. REAL PROPERTY DESCRIPTION The South 100.00 feet of the West 100.00 feet of the Northwest Quarter of the Northeast Quarter of Section 28, Township 32, Range 25, Anoka County, Minnesota. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. 2)' That if the real property as described above cannot be acquired by direct negotiation, it shall be acquired by eminent domain. i I I I I I I I I I I I I
