City Administrator Norman stated that he could not speak as to whether completion of <br />preliminary plat allows for a buy down of the land, but if the Council does not proceed with <br />preliminary plat approval it will make negotiations more difficult. He noted that the Planning <br />Commission approved the preliminary plat a month ago. <br /> <br />City Attorney Goodrich inquired if there was any concern with the 60-day rule. <br /> <br />Assistant Community Development Director Trudgeon replied that staff would have to extend <br />the first 60 days, which can be done. <br /> <br />Mayor Gamec stated that his major concern with granting preliminary plat approval was if it <br />would commit the City to construct anything within the Town Center, but since the appropriate <br />language has been included in the resolution he was okay with proceeding with the preliminary <br />plat. <br /> <br />Councilmember Strommen was concerned if one thing would fall through during negotiations it <br />could impact the preliminary plat. <br /> <br />Councilmember Elvig expressed concern that if in fact preliminary plat approval is a trigger <br />mechanism to buy down land or negotiate sales, can it tie the City to a conduit agreement. <br /> <br />City Attorney Goodrich explained that it is not a condition of City Code that a sale happens or <br />not so that is not a City issue. By drafting the language within the preliminary plat resolution the <br />goals was to give preliminary plat approval, but take away a good majority of what preliminary <br />plat approval means. <br /> <br />Councilmember Zimmerman stated that the Town Center is a multi million-dollar development <br />for the City of Ramsey where the City will be contributing a lot of money to certain aspects. He <br />felt that they should have everything in place before they grant preliminary plat because it does <br />grant certain rights to the developer. <br /> <br />Mayor Gamec inquired if staff felt that they would not be able to make changes to the layout such <br />as the location of an MSA road if they grant preliminary plat approval or were there safeguards in <br />place to do so. <br /> <br />City Attorney Goodrich explained that they would not be able to change the configurations <br />without the approval of the Ramsey Town Center, LLC after they grant preliminary plat <br />approval. <br /> <br />Councilmember Cook thought that they already solidified some of that when they approved the <br />zoning and what could be developed in those districts. <br /> <br />City Attorney Goodrich explained that the City has not approved the zoning at this time, they <br />have only introduced the ordinance, but the Comprehensive Plan is guiding towards those <br />zonings. <br /> <br />City Council/August 12, 2003 <br /> Page 22 of 30 <br /> <br /> <br />
