Councilmember Strommen replied that she wag not trying to hold up the process, but <br />she was concerned that if something happens during the discussion of the development <br />agreement that could cause a change to the layout of the plan. City Administrator Norman <br />explained that if the development agreement falls through it would be more of a problem for the <br />developer rather than the City. Mr. Jacobson stated that if changes like that were to occur it <br />would bring the Ramsey Town Center, LLC back into a whole different circumstance that may <br />relate to zoning, and physical design. The intent is for the Ramsey Town Center, LLC to move <br />forward with the negotiations based on this plan. Councilmember Elvig stated that a change in <br />the plan would have such a ripple effect and cost the developer thousands of dollars so he did not <br />see that really happening. Assistant Community Development Director Trudgeon stated that in <br />some respects by approving preliminary plat it puts the City in a better position because if there is <br />something they don't like the developer would have to go back through the entire process. City <br />Attorney Goodrich noted that the Council could include language in the approval of the <br />preliminary plat that in the event that the development agreement dictates amendment to the <br />preliminary plat it shall be amended accordingly not withstanding this approval. Councilmember <br />Elvig replied that he thought that language would be more ora detriment to the City rather than a <br />benefit. Councilmember Cook agreed that the language could be more of a detriment. <br />Councilmember Pearson stated that they had a plan before them that has been worked on for a <br />couple of years. Development has come into the City before and fallen into place and now they <br />are all concerned that after two years of discussions it won't fall into place. He felt that it was <br />time to move forward. Consensus of the Council was to not include the language suggested by <br />the City Attorney pertaining to changes to the preliminary plat. Councilmember Zimmerman <br />stated that if the Council moves forward with preliminary plat approval they give up some of <br />their leverage and it is lost forever. Councilmember Cook stated that preliminary plat approval is <br />not a development agreement. Staff will be continuing their work on the development <br />agreement. He did not think it was unusual for a developer to put on the table what they would <br />like to see and then have to negotiate that information. Councilmember Zimmerman replied that <br />there is a quite a bit of money they are talking about and the City needs to be conservative. <br />Councilmember Elvig stated that all along they were told that the developer would pay for the <br />development and then the first draft of the development agreement comes before them that the <br />City would pay the entire cost of the roads. It was a setback, but he did feel that it was time to <br />move forward. He called for the vote. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, and Councilmembers Cook, Pearson, and Elvig. <br />Voting No: Councilmembers Strommen, and Zimmerman. Abstained: Councilmember Kurak. <br /> <br />Councilmember Strommen stated that she wanted to vote in favor of the preliminary plat, but she <br />did not have comfort level of doing so without the additional documents. <br /> <br />Mr. Jacobson stated that the Ramsey Town Center, LLC has had nothing but total cooperation <br />from the Commissions, staff and the City Council and they really appreciate their participation. <br /> <br />Councihnember Zimmerman left at 10:40p.m. <br /> <br />City Council/August 12, 2003 <br /> Page 25 of 30 <br /> <br /> <br />
