I <br /> I <br /> I <br />I <br />I <br /> I, <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br /> CASE # <br /> INITIATE EMINENT DOMAIN PROCEEDING FOR THE <br /> ACQUISITION OF PROPERTY REQUIRED FOR THE <br /> C.R. #116 EXTENSION BETWEEN RAMSEY AND ARMSTRONG BOULEVARDS <br /> (IMPROVEMENT PROJECT #97-25) <br /> By: Steve Jankowski, City Engineer <br />Background: <br /> <br />At the September'9, 1997 meeting, an alignment for the extension of C.R. #116 between C.R. <br />#56 and C.R. #83 was selected by Council. This alignment, which is attached, calls for the <br />intersection of C.R. #116 to occur with C.R. #85 at a point approximately 2,000 feet north of the <br />Burlington Northem Railroad. Although this will be a county highway, the County policy <br />requires the City to obtain fight-of-way for the extension. The City has title to the first half-mile <br />west of C.R. #56, however, it needs to obtain title to the western portion of the alignment which <br />covers three properties and involves the acquisition of 8.2 acres. A copy of the alignment has <br />been forwarded and reviewed by the Anoka County Highway Department. <br /> <br />The City desires to expedite this project and, therefore, acquisition of the right-of-way should <br />occur as soon as possible. While passage of condemnation proceedings do not preclude <br />negotiation with the property owner, it does ensure that legal acquisition does not become <br />protracted. <br /> <br />Recommendation: <br /> <br />Staff recommends that the City Council adopt a resolution authorizing the initiation of <br />condemnation proceeding, authorizing the City Administrator to obtain appraisals of the <br />properties to be acquired, and directing the City Attorney to negotiate a purchase price for the <br />properties to be acquired. <br />Council Action: ¢~ <br />Motion to adopt Resolution #97-09-XXX authorizing acquisition of property for Highway <br />purposes. <br /> <br />Reviewed by: <br /> <br />City Engineer <br />City Administrator <br />Administrative Services Manager <br />City Attorney <br />Finance Director <br /> <br />CC: 09/23/97 <br /> <br />/jmt <br /> <br /> <br />
