Councilmember introduced the following resolution and moved for its adoption: RESOLUTION #97-09- RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR HIGHWAY PURPOSES WHEREAS, the extension of C.R. #116 between C.R. #56 and C.R. #83 will greatly enhance the arterial transportation network within the City of Ramsey, and consequently will benefit the health, safety and welfare of the City; and WHEREAS, it is current policy that the City is responsible for the provided right-of- way for the construction of new county roads within the City; and WHEREAS, the City finds it necessary to acquire the fee title to certain real property in order to provide property for the construction of said highway; and WHEREAS, the City has the right to acquire the real property for the Public Improvement by eminent domain pursuant to Minn. Stat. Chapter I 17; and WHEREAS, the City has the fight to acquire the real property prior to filing of an award by the Court Appointed Commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and WHEREAS, the property owner of the real property which needs to be acquired has been identified as follows: Legal Description NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Administrator is hereby directed to acquire the real property as described above in accordance with Minnesota Statutes. The City Administrator is authorized to negotiate and represent the City of Ramsey in all proceedings. 2) That if the real property as described above cannot be acquired by direct negotiation, it shall be acquired by eminent domain. 3) That the City Cou'ncil hereby authorizes acquisition of the said real property by eminent domain and to take title and possession of that land prior to filing of an award by the Court Appointed Commissioners pursuant to Minnesota Statutes § 117.011 and § 117.042. 4) That the City Attorney is authorized to file the necessary petition therefore, and to prosecute such action to a successful conclusion or until it is abandoned, dismissed or terminated by the City or Court.
