Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #97-09- <br /> <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY FOR HIGHWAY <br />PURPOSES <br /> <br /> WHEREAS, the extension of C.R. #116 between C.R. #56 and C.R. #83 will greatly <br />enhance the arterial transportation network within the City of Ramsey, and consequently will <br />benefit the health, safety and welfare of the City; and <br /> <br /> WHEREAS, it is current policy that the City is responsible for the provided right-of- <br />way for the construction of new county roads within the City; and <br /> <br /> WHEREAS, the City finds it necessary to acquire the fee title to certain real property in <br />order to provide property for the construction of said highway; and <br /> <br /> WHEREAS, the City has the right to acquire the real property for the Public <br />Improvement by eminent domain pursuant to Minn. Stat. Chapter I 17; and <br /> <br /> WHEREAS, the City has the fight to acquire the real property prior to filing of an award <br />by the Court Appointed Commissioners, pursuant to Minn. Stats. §117.011 and §117.042; and <br /> <br />WHEREAS, the property owner of the real property which needs to be acquired has been <br />identified as follows: <br /> <br />Legal Description <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Administrator is hereby directed to acquire the real property as described <br />above in accordance with Minnesota Statutes. The City Administrator is authorized to <br />negotiate and represent the City of Ramsey in all proceedings. <br /> <br />2) <br /> <br />That if the real property as described above cannot be acquired by direct negotiation, it <br />shall be acquired by eminent domain. <br /> <br />3) <br /> <br />That the City Cou'ncil hereby authorizes acquisition of the said real property by eminent <br />domain and to take title and possession of that land prior to filing of an award by the <br />Court Appointed Commissioners pursuant to Minnesota Statutes § 117.011 and § 117.042. <br /> <br />4) <br /> <br />That the City Attorney is authorized to file the necessary petition therefore, and to <br />prosecute such action to a successful conclusion or until it is abandoned, dismissed or <br />terminated by the City or Court. <br /> <br /> I <br /> I <br /> I <br /> I <br /> I <br />I <br />I <br /> <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br /> <br />
