The maximum slope other than the working face shall be sloped on all sides no steeper than a rate of 2 foot horizontal to 1 foot vertical. In no case shall the slope of the working face be left unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When mining operations are anticipated to be discontinued for an interval greater than two working days, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical. Final slopes Shall be consistent with the plan submitted and shall be no steeper than 12 feet horizontal to 1 foot vertical. Prior to commencing any grading operations, a cash escrow or letter of credit approved as to form by the City in the amount often Thousand Dollars and no cents ($10,000.00) shall be deposited with the City. This financial guarantee may be used by the City to pay for the cost and expense of repairing any public right of ways or regrading and stabilizing eroded areas due to the grading operation, pay for any cost associated in administering the requirements of this Chapter of the City Code, and to pay for any restoration of the worksite not properly restored upon completion. The Permit Holder agrees to permit access to the property by the City to facilitate restoration, if necessary. The Permit Holder shall implement sediment and erosion control practices. No grading activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed along the property line to prevent sediment from washing onto the adjoining property. Any erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a property line shall be regraded within forty-eight (48) hours of the precipitation event that caused the er0s~on, There shall be' no stockpiling of graded materials, other than the topsoil on a temporary basis in the locatiofis 'specified in the application submittals, allowed within the boundaries of the Subject Property. The permit hol~ler shall file with the City a liability insurance policy or certificate of such insurance acceptable to the City and issued by an insurance company authorized to do business in the State of Minnesota. a. The policy 'shrill insure the permit holder for the sum of at least'S300,000 for injury to one person and $500,000 for one accident, and at least $ I, 100,000 property damage. bo Said policy Shall be for the full period of the permit and shall provide for the giving of 10 days prior notice to the City by registered mail of termination, cancellation or amendment of the policy. In the event said policy is terminated for any reason, the'permit shall be automatically suspended.' ~Pon the day the policy terminates unless a new policy complying with this item is obtained and filed with the City prior to the termination of the policy in force. The maximum n'oise level at the perimeter of the worksite shall be within the limits set by the Minnesota Pollution Control Agency and the Environmental Protection Agency of the United States.
