Both of these approvals were granted on April 9,
1996 and are valid for a one year time frame unless an extension is approved by the City
Council. Technically, the one year time frame has lapsed but Gouncil has accepted belated
requests for consideration of extensions in the past.

In your August 26, 1997 transmittal, you assume that the conditional use permit approved in
1996 is in effect and that is not the case. That permit was issued in concert with the building
expansion and that has not occurred and the one year time frame for initiation of that amended
conditional use permit has lapsed. Therefore, the conditional use permit in effect is the one
issued in 1991. I have reviewed both permits and except for the following, they are identical and
should not impact continuance of your operations:

All references to ash in the 1991 permit were changed to dross in the 1996 proposed permit.
The 1991 permit required storage of dross in a building and {he' 1996 permit allowed for
storage of dross in a leakproof container, which was the situation at the time. If the 1996
permit approval is extended and if the manner of dross storage becomes an issue prior to
implementation of the 1996 permit, then Staff would support that the proposed permit on
record clearly reflects Council's intent that storage of dross in a leakproof container is
acceptable.

I
I

I
I
I
I
I
I
