There is no <br />public interest in retaining this easement and it remains an issue between property <br />owners. <br /> <br />Drainage and Utility Easements. The drainage and utility easements shown on the <br />proposed final plat are acceptable to accommodate the on site drainage and sewer and <br />water utilities. However, there may be slight deviations in the large drainage easement on <br />the northwest corner of the plat to accommodate recent site plan modifications. <br /> <br />In accordance with City Code, the standard drainage and utility easements are provided <br />around the perimeter of each lot. There is a pre-existing 10 foot drainage and utility <br />easement that extends from the northeast corner of Lot 3 to the north plat boundary that is <br />not shown on the plat. If this easement is no longer necessary, then the developer must <br />request City Staffto initiate action to vacate that easement. <br /> <br />As noted at the time Deal Industrial Park was platted, there is the potential for Mn/DOT <br />to acquire access rights on T.H. #I0 in the future. In the event this becomes a reality, th~ <br />City should be planning for alternate access and therefore required a 40 foot wide <br />easement along the north plat boundary of Deal Industrial Park to facilitate a future <br />service road. In accordance with Staff's request, that 40 foot wide easement has been <br />carried through onto this plat. <br /> <br />Storm Water Management Fee. The City has established a stormwater management <br />fund at a rate of $3,500 per acre for commercial plats. In this case, the underlying Lot 1 <br />of Deal Industrial Park should be exempt from the total land calculation in computing the <br />amount of stormwater management fees due on this plat. <br /> <br />Park Dedication. The plat will be reviewed by the Park Commission on October 9, 1997 <br />for park dedication requirements. It is anticipated that park dedication will consist of a <br />cash payment for the 2 new lots created. <br /> <br /> <br />
