I
I
I
I
I
I
I
I
I
I
I
I
I
I

I
I

Further discussion: Councilmcmber Zimmerman inquired if casements can bc put on thc
plat. Mr. Goodrich did not think so but they could be shown as drainage and utility
easements. He stated we are limited as to what we can show on the map.

Motion carried. Voting Yes: Mayor Gilbcrtson, Councilmembers Zimmerman, Beyer,
Hardin and Pcterson. Voting No: None.

Case #14: Concept Approval/Option Agreements

City Administrator Schroeder stated that there is a company that has made an announcement
that it's locating in Ramuey. He referred to a map enclosed with the case and stated that
they have expressed a desire to locate on what is shown as Lot 1. They arc not interested
in the parcels thc City can currently make available on thc Eggum property we are
purchasing. Also, currently, Uranium Street N.W. does not provide access to any
marketable site, nor will it prior to thc proposed February ground brealdng. Mc stated he
has been working on a trade for land north of that area that thc City already owns but he felt
it would not occur because the owner of thc property has not decided ff he will expand to
thc north or west. Mr. Schroeder stated he is looking for options. One is thc site
mentioned, one would be a portion of the 12-acre site the City owns to the north of that lot
and thc third would be a site west of these lots. He stated that the second site has an
additional "wrinlde". To make thc site enhanced, it might make sense to acquire the "Amie
Cox" site from Waste Management. We would move property divisions of our existing
site. He stated he is not sure ff he can make this issue any more clear but stated he would
llke the ability to negotiate an acceptable purchase agreement for what turns out to be the
chosen site and that he would like Council to introduce thc ordinance which says the City
of Rarn.qey is intending to sell its ownership on any lots mentioned in the ordinance. The
intent is that prior to thc adoption of this ordinance, thc issue of ownership Mil be "put to
bed".

Motion by Councilmcmber Peterson and seconded by Councilmember Z~mmerman to
authorize the City Administrator to enter into a purchase agreement on the chosen property.

Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Zimmerman,
Beyer and Hardin. Voting No: None.

Motion by Councqlmember Pcterson and seconded by Mayor Gflbcrtson to introduce thc
proposed ordinance authori~ng sale of acquired properties.

Motion carried. Voting Yes: Mayor Gilbertson, Counc~lmembers Peterson, Beyer, Hardin
and Zimmerm~n. Voting No: None.

Case

Request for Preliminary Plat Approval of Town Houses of
Rum River Hills; Case of Wilbur Dom and Thomas Anderson

Zoning Administrator Prolik stated that Wilbur Dom and Thomas Anderson arc requesting
preliminary plat approval of "Town.houses of Rum River Hills" which is proposed to replat
Lot 1, Block 2, and Ouflot C, Rum River Hills, into 12 town house lots. The 12 units
would be served by on-site septic systems and wells. Park dedication will be satisfied by a
cash payment. The town houses are proposed to be served by a private road. Although the
City is not the enforcing agency, the City will be requesting to be provided with a copy of
the covenants for furore reference and to ensure adequate attention is given to the details of
how the private road will be maintained and the course of action in the event of septic
system failures. The developer has submitted a Landscape Plan that proposes to establish a
berm planted with trees between the town houses and several adjacent homes to the west.

City Council/December 13, 1994
