" SubcL & Criteria For Healf~h rrazarcL Criteria for determination that a sysbem is a health hazard shall include, but not be ]~mlted to, the following: a. The appearance of on-site disposal system effluent into surface waters at any time, or on the ~round surface continuously or int~rmittendy over a period o£ 15 consecutive days. b. The exposure for more than 72 hours o£ an on-site system or part thereof that is in use. c. A system 'in which the level of e~uent is sufficiently close to the ~round surface to result in offensive odors. Subd. 4~ l~ight To l~epair. In case the owner shall fail, neglect, or refuse to comply with the notice to repair or rehabilitate or abate as described in section above, the City Council may order the owner of the building prosecuted as a violator o£ the provisions o£ this section ~d may order the pl~mbing inspector to proceed with the work specified in such notice. A statement o£ the cost of such work shall be transmitted to the City Council, who shall cause the s~r~e to be paid and levied as a special assessment against the property. Sub& 5. Costs. Costs incurred under §8.30.08 Sub& 4. shall be paid out of" the CiW's Eenera] Amd.
