6. LIGHTING. Any lighting installed on the Structure shall be designed to deflect <br />light away from 149th Avenue N.W. and is subject to the approval of the City Engineer. <br /> <br />7. SIGNS. Signs erected on the property shall be in conformance with the covenants <br />for Pineview Estates 2nd Addition Planned Unit Development. <br /> <br />8. DRAINAGE. The proposed residence and commercial Structure are located in <br />an area which has been excavated for sand borrow material. The building elevations are <br />very close to the existing elevations and it is herein agreed that the Permittee accepts full <br />responsibility for adequate drainage away from the Structure and residence. <br /> <br />9. REQUIREMENTS FOR BUILDING PERMIT AND CERTIFICATE OF <br />OCCUPANCY. No building permit for the Structure will be issued until: 1) the <br />Permittee has signed and returned this Development Permit; 2) the escrow requirements <br />of Paragraph 10 below have been satisfied; 3) the Permittee has reimbursed.the City for <br />ail expenses incurred in approval of the site plan; 4) the City has been provided with <br />written confirmation that the homeowners in the PUD do not object to the placement of <br />the driveway access along the east property line and that the Permittee understands and <br />agrees to cooperate with any future owner of Lot 1 in the event a driveway access along <br />the common property line with the Site is required in accordance with the PUD <br />covenants. No Certificate of Occupancy of the Structure will be issued until: 1) the <br />Required Improvements are accepted by the City or a financial surety for same is in effect <br />at the City; 2) the Permittee has reimbursed the City for all expenses incurred during the <br />construction of the Required Improvements; and 3) a building permit has been issued for <br />the residence on the Site. <br /> <br />10. IMPROVEMENT CONSTRUCTION SCHEDULE. The Required <br />Improvements shall be constructed and installed on or before October 1, 1998. <br /> <br />11. ESCROW. tn order to insure the installation of the Required Improvements in <br />accordance with City specifications and in a timely mariner, the. Permittee shall be <br />required to deposit with the City a cash escrow or letter of credit approved by the City in <br />the amount of Ten Thousand Five Hundred Dollars and no cents ($10,500.00), which is <br />150% of the City's estimated cost oft he Required Improvements. <br /> <br />Upon completion of the construction of the Required Improvements, as certified by the <br />City Engineer, the escrow shall be returned to the Permittee. In the event the Permittee <br />fails to construct and install the Required Improvements as required herein, the City may <br />complete the Required Improvements'with City day labor and/or by letting contracts for <br />said completion and draw upon the escrow for payment.
