In the event that additional WORK is needed and the lowest responsible BIDDER is unable to perform the <br />WORK, the additional WORK will be offered to the next lowest responsible BIDDER. The NOTICE TO <br />PROCEED shall be issued within ten (10) days of the execution of the CONTRACT by the CITY. Should there be <br />reasons why the notice to proceed cannot be issued within such a period, the time may be extended by mutual <br />agreement between the CITY and the selected BIDDER. If the NOTICE TO PROCEED has not been issued <br />within a ten (10) day period or the period mutually agreed upon, the selected BIDDER may terminate the <br />CONTRACT without further liability on the part of either party. <br /> <br />The selected BIDDER will be required to execute the CONTRACT and obtain the required insurance certificates <br />within ten (10) calendar days from the date the notice of award is executed by CITY. In the case of failure of the <br />selected BIDDER to execute the CONTRACT, the CITY may at its option consider the selected BIDDER in <br />default, in which case, the CITY may award the BID to the next lowest responsible BIDDER. <br /> <br />The CITY, within ten (10) days of receipt of the acceptable INSURANCE CERTIFICATES and CONTRACT <br />signed by the selected BIDDER, shall sign the CONTRACT and return to such party an executed duplicate of the <br />CONTRACT. Such notice of withdrawal shall be effective upon the receipt of that WRITTEN NOTICE by the <br />CITY. <br /> <br /> <br />
