CASE # / <br /> <br />LIGHTHOUSE GRILLE & BAR ON-SALE LIQUOR LICENSE SUSPENSION <br /> <br />By: <br /> <br />William K. Goodrich, City Attorney <br />Dave Gustafson, Police Chief <br /> <br />Background: <br /> <br />As noted in your consent agenda on November 10, 1997, the City has <br />charged the Lighthouse Grille & Bar owned by Barnyard <br />Entertainment, Inc. (the "Licensee") with selling an alcoholic <br />beverage to a person under age 21. The Licensee's employee selling <br />the alcoholic beverage has been charged with this offense in <br />District Court and the under age person has also been charged in <br />District Court for minor consumption. <br /> <br />The Licensee has a right to a public hearing to contest the charge. <br />The Licensee has chosen to waive the public hearing and enter into <br />a stipulated agreement whereby its license would be suspended for <br />one day as a penalty for the violation. See the proposed <br />stipulation and order attached for further background information. <br /> <br />Recommendation: <br /> <br />After review of the circumstances and speaking with the licensee's <br />management, we recommend that the City suspend the licensee's on- <br />sale license for one day as penalty for the violation. <br /> <br />Council Action: <br /> <br />Motion to enter into the attached stipulation suspending Barnyard <br />Entertainment, Inc.'s on-sale intoxicating liquor license for one <br />day. <br /> <br />Review Checklist: <br /> <br />Linda Waite-Smith, <br />Acting City Administrator <br /> <br /> <br />
