WIIEREAS, the Licensee admits that on October 5, 1997 one of <br /> its employees sold an alcoholic beverage to a person under 21 years <br /> of age, the under age person being Matthew William Bakke, DOB: <br /> 8/4/78; and <br /> <br /> W~ERE&S, the Ramsey City Council finds that this is the first <br />offense by the Licensee for selling alcohol to a person under 21 <br />years of age and the Licensee has never been cited for any other <br />Section 7.52 or Liquor Act violation; and <br /> <br /> WI{EREAS, the Licensee's employee has been charged in District <br />Court with the crime of selling an alcoholic beverage to an under <br />age person; and <br /> <br /> WIIEREAS, the under age person has been charged in District <br />Court with minor consumption; and <br /> <br /> Wt{EREAS, the Licensee has been advised of its right to have a <br />contested public hearing at which time it may present evidence <br />before the City Council in an effort to obtain a finding that <br />alcohol was not illegally sold by the Licensee; and <br /> <br /> W~EREAS, the Licensee, notwithstanding the right to a public <br />hearing desires to waive the hearing and instead enter into this <br />Stipulated Agreement. <br /> <br /> NOW, T~REFORE, it is stipulated and agreed to by and between <br />the parties hereto as follows: <br /> <br /> 1. That the Licensee admits that on October 5, 1997, its <br />employee sold and served an alcoholic beverage to one, Matthew <br />William Bakke, DOB: 8/1/78, in violation of both Section 7.52 and <br />the Liquor Act. <br /> <br />2 <br /> <br /> <br />
