1 <br />I <br />I <br />j <br />�1 <br />CASE # / N <br />REQUEST FOR A CONDITIONAL USE PERMIT TO CONSTRUCT AN <br />ACCESSORY BUILDING ON A LOT PRIOR TO THE PRINCIPAL BUILDING; <br />CASE OF JUDY KUEMPER <br />By: Zoning Administrator Sylvia FroIik <br />Background: <br />On October 14, 1997, the City received an application from Elmer and Judy Kuemper for a <br />conditional use permit to construct an accessory building on a lot prior to there being a principal <br />building or dwelling on the property. The property is located on the south side of 151 st Avenue <br />N.W. in the vicinity of Fluorine Street. The following items are enclosed for your information: <br />a) Site location map <br />b) Site Plan <br />c) Letters from area property owners <br />d) Draft public hearing and regular Planning Commission meeting minutes dated <br />November 4, 1997. <br />e) Proposed findings of fact <br />f) Proposed conditional use permit <br />Notification: <br />Conditional Use Permits are required to be subjected to public hearings and all properties within <br />' 350 feet of the subject property are to be notified. Staff attempted to notify property owners <br />within 500 feet of the subject property. <br />1 <br />i] <br />I <br />Observations: <br />City Code states that no accessory building shall be constructed on a lot unless there is a <br />principal building (a home in this case) on the lot. Elmer and Judy Kuemper would like to <br />construct a pole barn on their property but their homestead actually consists of two lots of record. <br />They plan to place the new pole barn on the lot that does not contain their house. If they chose <br />to, they could replat the property into one lot and then they would not need a conditional use <br />permit for the proposed accessory building (provided they were not exceeding the allowable <br />garage and accessory building space). <br />At the time of the Planning Commission meeting, the Kuemper's plan was to build this new pole <br />barn for the storage of personal vehicles and equipment only. They indicated at that time that the <br />existing horse barn on the property would be z.:paired and reduced in size so that the total <br />allowable accessory building space would not be exceeded with the construction of the new <br />building. <br />1 <br />113 <br />
