1 <br />Subsequent to the Planning Commission meeting, the Kuempers decided that the barn is in such <br />disrepair that it should be totally demolished and removed from the property and part of the <br />newly proposed building could be used to stable their horses. City Code requires that buildings <br />housing animals be located 75 feet from any property line and 50 feet from any residence. The <br />Kuempers have located the proposed building so that it meets the 75 and 50 foot distance <br />requirements from neighboring properties but not their own. They have applied for a variance to <br />construct the pole barn 2 feet from their own common property line and 48 feet from their own <br />home. The variance application will be submitted to the Board of Adjustment on December 2. <br />Staff has taken the libertyto amend the findings of fact proposed b the Planning Commission to <br />g P p Y g <br />reflect the existence of a barn on the site and the plan to remove it from the property. <br />The Planning Commission conducted the public hearing on November 4 and 3 letters were <br />received from area a property owners. The letters express concern that there be no commercial <br />activity allowed in the new building, that the number of horses- kept on the property be in <br />accordance with City Code, and that the existing barn either be repaired or removed. <br />Recommendation: <br />The Planning Commission recommended approval of the request for a conditional use permit <br />provided the pole barn be designed with soffit, fascia and eaves. <br />°- <br />Council Action: t i�' �' <br />Motion to adopt Resolution #97-11-� dopting Findings of Fact # Q4( relating to Elmer and <br />Judy Kuemper's request for a conditional use permit.
