CASE NO. <br />i <br />AUTHORIZE ADDITIONAL PLANNING REGARDING IMPLEMENTATION <br />OF RECENTLY ADOPTED CHARTER AMENDMENT AND <br />CONSIDERATION OF EXTENSION OF RESIDENTIAL <br />DEVELOPMENT MORATORIUM <br />By: William K. Goodrich, City Attorney <br />Background: <br />I <br />1 <br />I <br />With the passage of Charter Section 14.2 on September 23, 1997, the <br />City is obligated to implement this section. This will likely <br />consist of adopting an ordinance to provide for the details <br />necessary to implement and enforce the Charter provision. For this <br />purpose, and in order to have appropriate data available in the <br />event suit is brought contesting this Charter Amendment and/or its <br />interpretation, I previously recommended that a planner be <br />retained. Mayor Gamec and I have met with Fred Hoisington to <br />discuss this project. Mr. Hoisington has agreed to undertake this <br />work and his proposal, dated November 6, 1997 is attached. <br />In order to fully complete the project and respond to the resulting <br />recommendations the Council should consider extending the current <br />moratorium on residential development which is now set to expire in <br />January, 1998. In January, 1998, the moratorium will have been in <br />place for six months. State law permits a moratorium for a maximum <br />of 30 months. <br />Recommendation: <br />1. Amend the current Hoisington Koegler Group, Inc. comprehensive <br />planning contract by addition of services and on the terms <br />described in the Hoisington's November 6, 1997 letter. <br />2. Direct staff to prepare an ordinance for introduction on <br />December 9, 1997 which ordinance will extend the existing <br />residential development moratorium through July 31, 1998. <br />Council Action: <br />1. Motion to amend the Hoisington Koegler Group', Inc. Is current <br />comprehensive plan services contract by adding additional <br />services in the scope and on the terms and conditions as <br />outlined in their letter dated November 6, 1997. <br />2. Motion to direct staff to prepare an ordinance for <br />introduction on December 9, 1997, which ordinance will extend <br />the current residential development moratorium such that the <br />moratorium shall expire on July 31, 1998. <br />Review Checklist: <br />A ity Administrator <br />Zoning Administrator <br />
