corrective actions to bring the system into compliance with this <br />' chapter. All such work shall be completed within 90 days from <br />the date of the notice, unless otherwise stipulated by the plumbing <br />' inspector. If necessary, such notice may also prohibit forthwith <br />any further discharge into the system until all defects have been <br />abated and approved by the plumbing inspector. <br />b. Proper service of such notice shall be by personal service upon the <br />owner of record, if he shall be found within the Ramsey <br />municipal limits. If he is not found within the Ramsey <br />municipal limits, such service may be made upon said owner by <br />registered mail or certified mail, provided that if such notice is by <br />registered mail or certified mail, the designated period within <br />which said owner or person 'in charge is required to comply with <br />the order of the plumbing inspector shall begin as of the date he <br />receives such notice. <br />c. At the time of service of notice as above described, the plumbing <br />inspector shall also by mail forward a copy of said notice to the <br />City Council. <br />Sub& S. Criteria For Health Hazard. Criteria for determination that <br />a system is a health hazard shall include, but not be limited to, the following: <br />a. The appearance of on -site disposal system effluent into surface <br />waters at any time, or on the ground surface continuously or <br />intermittently over a period of 15 consecutive days. <br />b. The exposure for more than 72 hours of an on -site system or part <br />thereof that is in use. <br />c. A system in which the level of effluent is sufficiently close to the <br />ground surface to result in offensive odors. <br />Subd..4. Right To Repair. In case the owner shall fail, neglect, or <br />refuse to comply with the notice to repair or rehabilitate or abate as described in <br />section above, the City Council may order the owner of the building prosecuted as a <br />violator of the provisions of this section and may order the plumbing inspector to <br />proceed with the work specified in such notice. A statement of the cost of such <br />work shall be transmitted to the City Council, who shall cause the same to be paid <br />and levied as a special assessment against the property. <br />Subd.5. Costs. Costs incurred under §8.30.08 Subd. 4. shall be paid <br />out of the City's' general fund. Such costs shall be charged to the owner of the <br />premises involved as special assessment on the land on which the building or <br />structure is located, and shall be collected in the manner provided for special <br />assessments. <br />Subdivision L Rnforcement. <br />Printed 12/28/90 <br />Page 265 <br />0 <br />
