Goodrich, City Attorney <br /> <br />Background: <br /> <br />In the winter/spring of 1997, the City Council authorized entering into a purchase agreement <br />with Vern Halderson, et al. for approximately 83 acres of land lying generally west of Highway <br />#47 and east and south of Menkveld's Country Park, all in Section 14, Township 32, Range 25. <br />This land was .to be used for park/open space purposes. The purchase agreement was contingent <br />upon the City's final approval of the Apple Ridge subdivision and, if said approval was not <br />granted prior to September 1, 1997, the agreement is null and void. <br /> <br />In June 1997, the sellers indicated to Ryan Schroeder that they did not want to proceed with the <br />sale. The Apple Ridge subdivision has not been given final approval and, therefore, the <br />agreement is null and void and not legally binding on either party. <br /> <br />Recommendation: <br /> <br />If the Council is interested in pursuing a new purchase agreement with the Haldersons, Council <br />should direct staff accordingly.
