COUNCIL BUSINESS Case #1: Request for a Conditional Use Permit to Construct an Accessory Building on a Lot Prior to the Principal Building; Case of Judy Kuemper Zoning Administrator Frolik reported that the City received an application from Elmer and Judy Kuemper for a conditional use permit to construct an accessory building on a lot prior to there being a principal building or dwelling on the property. The property is located on the south side of 151st Avenue in the vicinity of Fluorine Street. City Code states that no accessory building shall be constructed on a lot unless there is a principal building (i.e., home) on the lot. The Kuempers would like to construct a pole barn on their property which consists of two lots of record. Councilmember Haas Steffen noted that one of the comments received from neighbors related to an existing barn that has to be repaired or removed. She suggested there should be a timeline written in the conditions. Ms. Frolik stated that a final occupancy permit will not be issued until that building is repaired or removed. Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to adopt Resolution #97-I 1-330 adopting Findings of Fact #0448 relating to Elmer and Judy Kuemper's request for a conditional use permit. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Beahen, Beyer and Haas Steffen. Voting No: None. Motion by Councilmember Haas Steffen and seconded by Councilmember Beyer to adopt Resolution #97-11-331 approving the issuance of a conditional use permit based on Findings of Fact #0448 and declaring terms of permit to construct an accessory structure prior to the principal building on a parcel. To the first condition, add the following language: .... and the certificate of occupancy will be withheld until all is complied with. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Beyer, Beahen and Zimmerman. Voting No: None. Case #lA: Report from Snowmobile Committee Police Chief Gustafson reported that the Snowmobile Committee met on November 18, t997, with 31 people in attendance (29 Ramsey residents, 1 Andover resident and 1 resident from Burns). He presented the Committee with the 1996 and 1997 police reports dealing with snowmobiles. The biggest concerns mentioned at the meeting were of damage to public right-of- ways, that snowmobiling starts too early in the year, and obstructions being placed in ditches.
