I <br />I <br />I <br />I <br />I <br />! <br />I <br />! <br />! <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Mayor Gamec announced that the City wishes to continue to allow snowmobiling, however, this <br />year will be the test of whether or not it will be allowed to continue. <br /> <br />Case #2: Youth Access to Tobacco Ordinance Consideration <br /> <br />City Attorney Goodrich reminded Council that the City is mandated to adopt an ordinance for the <br />purpose of controlling youth access to tobacco. All of the City's businesses have been given <br />notice of the meetings where this will be discussed. He asked that the record reflect the fact that <br />Council received a letter from the Merchandise Manager of Food-N-Fuel, Inc., stating they do <br />not want the City to ban all self-service displays of tobacco products. Mr. Goodrich summarized <br />the purpose portion of the language in the ordinance. <br /> <br />License fees were discussed and will be continued. <br /> <br />Discussion ensued relating to vending machines. Jim Bromberg, President of Midwest Vending, <br />was present and talked about the vending machines that have to be activated by an employee. He <br />felt this type of machine would offer the control needed. <br /> <br />Consensus was to amend Section 600 (b) which deals with vending machines. They agreed to <br />the lock-up type of vending machine. <br /> <br />Section 800 deals with compliance and consensus of the Council was to give the vendor 60 days <br />to come into compliance with the ordinance. <br /> <br />It was noted that Section 1000 deals with compliance checks which will require additional staff <br />time. <br /> <br />Penalties for non-compliance with the tobacco ordinance were discussed and it was stated that <br />that a fine schedule could be discussed further and the rates would be listed in the Schedule of <br />Rates and Charges which would allow change by resolution versus ordinance. <br /> <br />Consensus of the Council was that this ordinance should be amended and placed back on the <br />December 9, 1997 Council meeting for consideration of introduction. <br /> <br />Case #3: <br /> <br />Authorize Additional Planning Regarding Implementation of Recently <br />Adopted Charter Amendment and Consideration of Extension of Residential <br />Development Moratorium <br /> <br />City Attorney Goodrich noted a proposal from the firm of Hoisington Koegler Group Inc., for <br />additional planning services relating to the City's most recent Charter amendment. He pointed <br />out that it is not necessary to act on this tonight but it's become somewhat of a timely issue to <br />extend the development moratorium. <br /> <br />Charter suggested that the review should not be limited to the most recent Charter amendment, <br />but the other amendments as well.
