Goodrich <br />Randall, Dahn & Goodrich <br />2140 Fourth Avenue North <br />Anoka, MN 55303 <br /> <br />BY FAX AND MAIL <br /> <br />Dear Mr. Goodrich: <br /> <br /> Yesterday, you informed me that the Ramsey Charter Commission may adopt, <br />at its meeting scheduled for April 18, 1996, an amendment to the charter which would <br />give the City's voters a choice between two amendments dealing with the same <br />subject. One has been offered by petition; the other would be offered by the <br />commission. With regard to an amendment offered by the commission, the procedure <br />for submission is governed by Minn. Stat. §§ 410.07, 410.10, Subd. 2 and §410.12, <br />Subd. 4. <br /> <br /> Accordingly, if the Charter Commission proposes the amendment, it should <br />deliver the draft to the city clerk (section 410.07). Thereupon, the council must <br />meet to give notice of the election and order publication "once a week for two <br />successive weeks in the official newspaper of the City." (Section 410.10, Subd. 2) <br />At the council meeting the coUncil will fix the form of the ballot. "The statement of <br />the question on the ballot shall be sufficient to identify the amendment clearly and <br />to distinguish the question from every other questions on the ballot at the same <br />time." (Section 410.12, Subd. 4) If an amendment passes by 51% of the votes cast, <br />copies must be filed as with the original charter. The amendment takes effect 30 <br />days after the election, unless some other effective date appears. <br /> <br /> Because of the shortness of time, please leave word at 337-9211 that you have <br />received this fax as soon as you receive it.
