Constantine City: Attorney Eveleth, ~iinnesota Dear Sir: QUESTION !: Can the board of freeholders constituting the charter commission propose an amendmont to the city chaucer if the emend- ment is not pe:itioned for'by five per cent of the voters of the city? OPINION: The pertinent constitution~2 and statuto~? provisions will be firs~ referred to. The Minnesota Constitution, Article IV, Section 36, p~c- rides in par~ as follows: '~City or village may frame its own charter~ charter to be submitted to voters. Sec. 36. Any city or village in this State may frame a charter for its own government as a city consisten~ with and subject to the laws of this State, as follows: The legislature 'shall provide, under such restrictions as it deems proper, for a board of fifteen freeholders, who shall be and for the 'past five years el;all have been qualified voters thereof, to be appointed by the district Judges of the Judicial district i~%;hich the city or village is situated, as the legislature may determine~ for a term in no event to exceed six years: which board ~ithin six months after its appointment, return to ~n~ chief magistrate of said city or village drmft of saidcna_.~ -'~.~' signed by the membc.r.~ of said board: or a maJc~mo~.
