it's indicated this would be for an area where Shorewood would not be a direct beneficiary. There <br />is no traffic impact from this property because it's just across the street. He commented on the <br />recent court case in the City of Eagan pertaining to a transportation impact fee. He added, so as not <br />to stall, we would like to recommend on-going discussions with staff on this fee and the legality of <br />it but to indicate our good faith, we would agree to escrow these funds. That would allow the <br />building permit to proceed. <br /> <br />City Attorney Goodrich suggested that the City would perhaps be open to the money being <br />escrowed. <br /> <br />Mayor Hardin inquired if Mr. Hilger would consider redesigning the motor home on the roof top. <br />The building is beautiful and the lettering would identify it. <br /> <br />Councilmember Beyer stated she likes the roof-top design. <br /> <br />Mr. Hilger stated they would design the element with staff. <br /> <br />Mayor Hardin stated that it would be considered part of the square footage toward signage. <br /> <br />Mr. Hilger asked what if it was a clock. <br /> <br />Mayor Hardin replied he would have to think about that. <br /> <br />Mr. Hilger stated that the recreational vehicle logo may or may not be a sign. Details are still being <br />worked out. <br /> <br />Councilmember Zimmerman stated that with regard to the transportation impact fee, he felt the <br />courts did not object to money being spent in the area it was received from. The money would be <br />spent on g83 and T.H. gl0, and that's within distance of the building. Any business would rather <br />not pay more fees then they have to but we are also trying to make ends meet. We are looking at <br />safety factors. County Road g83 and Highway gl0 will be much safer now. It's a cost of doing <br />business. <br /> <br />Mr. Hilger cormnented that it's hard "being first". This fee becomes very steep for the small <br />businessman. The courts opinion appears to be in our favor but I feel we can discuss this. <br /> <br />Mr. Schroeder pointed out that every business since has paid the fee. <br /> <br />Mr. Hilger responded that he was not aware of that. <br /> <br />Ms. Frolik asked about Class V. <br /> <br />Mr. Hilger replied that it would be Class V for phase one and curb and concrete in phase two. <br /> <br />Ms. Frolik stated that business is restricted on Class V to which Mr. Hilger stated he understood <br />that. <br /> <br />Councilmember Peterson stated that he agrees with Mr. Hilger's statement about what if it were a <br />clock instead of a motorhome. He suggested that maybe Council should take a closer look at this. <br /> <br />Councilmember tteyer reiterated that she likes it and feels it add beauty to the building and to <br />Highway gl0. <br /> <br />City Council/October 8, 1996 <br /> Page 21 of 26 <br /> <br /> <br />
