Case #20: <br /> <br />Adopt Ordinance Renaming 147th Lane Northeast to 148th Avenue <br />Northwest in Chestnut Ridge 3rd Addition <br /> <br />City Administrator Schroeder reminded Council that they introduced this ordinance at their last <br />meeting which would correct a street named in error. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt <br />Ordinance g96-18 changing the name of 147th Lane Northeast to 148th Avenue Northwest in <br />Chestnut Ridge 3rd Addition. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Beahen aye <br />Councilmember Beyer aye <br />Councilmember Peterson aye <br />Councilmember Zimmerman aye <br />Mayor Hardin aye <br /> <br />Motion carried. <br /> <br />Case #21: Award Contract for Professional Audit Services <br /> <br />Finance Officer Hart summarized the process thus far for awarding the contract for professional <br />audit services. A management letter was requested and has been received from each of the fn'ms <br />that submitted proposals. The subcommittee (Finance Committee Chair Ken Peterson, City <br />Administrator Schroeder and Finance Officer Hart) reviewed the management letters. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Peterson to direct the City <br />Administrator and Finance Officer to enter into a three-year contract for Professional Audit <br />Services with the firm of Malloy, Montague, Karnowski, Radosevich & Co., P.A. for the not-to- <br />exceed prices as provided in the proposal. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beyer, Peterson, Beahen and <br />Zimmerman. Voting No: None. <br /> <br />Case #22: Update on Holmberg Lawsuit <br /> <br />City Attorney Goodrich gave an update on the City of Ramsey versus Arnold Holmberg (the Adult <br />Bookstore on Highway #10). The City adopted an ordinance prohibiting this business, at that <br />time, it was an adult use principal and it was too close to the school, child care, churches, etc. The <br />City intends to enforce the ordinance. They appealed and they lost. We are now authorized to <br />prevent operation on that site. The last possible date for them to appeal by is November 6. We <br />have not been advised if they will appeal or not. We are within our legal rights to enforce our <br />ordinance. <br /> <br />City Administrator Schroeder asked if it is Council's direction to proceed with enforcement. We <br />would view the site and see if he is in compliance. If not, we would take appropriate actions. <br /> <br />Mr. Goodrich stated we would be acting within the law. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to direct staff to <br />enforce the ordinance regarding the operation of the Adult Bookstore. <br /> <br />City Council/October 8, 1996 <br /> Page 24 of 26 <br /> <br /> <br />
