Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION NO. 97-02- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF <br />PERMIT BASED ON FINDINGS OF FACT # AND <br />PERMIT TO GRADE AND EXPORT SOILS <br /> <br />A CONDITIONAL USE <br />DECLARING TERMS OF <br /> <br /> WHEREAS, the Ramsey City Council adopted Resolution No. 99-02-__ adopting Findings <br />of Fact #~ for this use and herein approves the Conditional Use Permit subject to the following <br />conditions. <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />On , 1997 a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to Eric Thomsen ("Permit Holder") for grading operations on the property legally described as <br />follows: <br /> <br />That part of the Southwest Quarter of the Southwest Quarter of Section 2,Township 32, Range <br />25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, subject to <br />easement of record; <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka <br />County, Minnesota, lying southerly of County Road #63. <br /> <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />This permit shall expire three years from the commencement of operations and the Permit <br />Holder shall be responsible for providing the City with at least 48 hours advance notice of the <br />date of commencement of operations. <br /> <br />All grading operations shall be conducted in accordance with the grading plan dated January <br />14, 1997, prepared by E.G. Rud & Sons, Inc. The proposed area to be graded is roughly nine <br />(9) acres in size. Excavation shall be confined to a five (5) acre area at any time. Continuation <br />of grading shall require finished grade areas to be restored with six (6) inches of topsoil, seed <br />and disc anchored mulch. <br /> <br />All equipment used for grading and hauling operations shall be maintained and operated in such <br />a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. <br />All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed <br />from the worksite regularly. <br /> <br />The ingress and egress to the Subject Property shall be from County Road #63. The Permit <br />Holder shall provide a 75 foot long gravel approach at the access points onto County Road #63 <br />to minimize the tracking of grading materials from the site onto the highway. The Permit <br />Holder shall be responsible for obtaining any permits deemed necessary from Anoka County. <br /> <br /> <br />
