Councilmember introduced the following resolution and moved for its adoption: RESOLUTION NO. 97-02- A RESOLUTION APPROVING THE ISSUANCE OF PERMIT BASED ON FINDINGS OF FACT # AND PERMIT TO GRADE AND EXPORT SOILS A CONDITIONAL USE DECLARING TERMS OF WHEREAS, the Ramsey City Council adopted Resolution No. 99-02-__ adopting Findings of Fact #~ for this use and herein approves the Conditional Use Permit subject to the following conditions. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: On , 1997 a Conditional Use Permit ("CUP") was issued by the City of Ramsey ("City") to Eric Thomsen ("Permit Holder") for grading operations on the property legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 2,Township 32, Range 25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, subject to easement of record; The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying southerly of County Road #63. ("Subject Property:") This permit is issued pursuant to Section 9.03.04 and 9.1.18 of the Ramsey City Code. The conditions of this permit are as follows: This permit shall expire three years from the commencement of operations and the Permit Holder shall be responsible for providing the City with at least 48 hours advance notice of the date of commencement of operations. All grading operations shall be conducted in accordance with the grading plan dated January 14, 1997, prepared by E.G. Rud & Sons, Inc. The proposed area to be graded is roughly nine (9) acres in size. Excavation shall be confined to a five (5) acre area at any time. Continuation of grading shall require finished grade areas to be restored with six (6) inches of topsoil, seed and disc anchored mulch. All equipment used for grading and hauling operations shall be maintained and operated in such a manner to minimize noise, dust, and vibrations adversely affecting surrounding properties. All equipment shall be kept in good repair. Failed equipment and rubbish shall be removed from the worksite regularly. The ingress and egress to the Subject Property shall be from County Road #63. The Permit Holder shall provide a 75 foot long gravel approach at the access points onto County Road #63 to minimize the tracking of grading materials from the site onto the highway. The Permit Holder shall be responsible for obtaining any permits deemed necessary from Anoka County.
