o <br /> <br />o <br /> <br />o <br /> <br />10. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />All worksites shall be properly safeguarded to prevent the general public from depositing <br />garbage or other refuse on the worksite. <br /> <br />The disturbed area shall be reforested with a like number of trees. The trees shall be of similar <br />species as those removed and shall be a minimum of 1-1/2 inches in diameter. <br /> <br />Grading operations shall be conducted in such a manner to minimize interference with the <br />surface water drainage outside the boundaries of the operation. <br /> <br />Fencing may be ordered by the City Council or City Engineer anytime the permit is in force and <br />shall be installed within 24 hours of written notice. <br /> <br />All access roads to and from the Subject Property shall be maintained in order to minimize dust <br />and in a condition satisfactory to the City Engineer. When hauling operations are completed, <br />the permit holder shall either restore that haul road to a condition at least equal to that which <br />existed at the time the hauling operations were started, or compensate the local road authority in <br />an amount satisfactory to that road authority and concurred in by the City Engineer for the <br />restoration of that haul road. The City Engineer will then accept such restoration or concur in <br />such financial settlement for the restoration of the haul road in writing and such acceptance will <br />relieve the permit holder of any additional obligation in connection with the restoration of the <br />haul roads. If the permit holder fails or refuses to perform haul road restoration or to make <br />satisfactory financial settlement for such restoration, the City will cause the restoration work to <br />be done and require reimbursement from the financial guarantee required herein. <br /> <br />The maximum slope other than the working face shall be sloped on all sides no steeper than a <br />rate of 2 foot horizontal to I foot vertical. In no case shall the slope of the working face be left <br />unattended with a slope greater than 2 feet horizontal to 1 foot vertical. When mining <br />operations are anticipated to be discontinued for an interval greater than one working day, the <br />slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical. <br /> <br />Prior to commencing any grading operations, a cash escrow or letter of credit approved as to <br />form by the City in the amount of Ten Thousand Dollars and no cents ($10,000.00) shall be <br />deposited with the City. This £mancial guarantee may be used by the City to pay for the cost <br />and expense of repairing any public right of ways or regrading and stabilizing eroded areas due <br />to the grading operation, pay for any cost associated in administering the requirements of this <br />Chapter of the City Code, and to pay for any restoration of the worksite not properly restored <br />upon completion. The Permit Holder agrees to permit access to the property by the City to <br />facilitate restoration, if necessary. <br /> <br />The Permit Holder shall implement sediment and erosion control practices. No grading activity <br />shall occur within twenty-five (25) feet of a property line unless silt fence is placed along the <br />property line to prevent sediment from washing onto the adjoining property. Any erosion <br />which causes gullies of greater than one (1) foot within twenty-five (25) feet of a property line <br />shall be regraded within forty-eight (48) hours of the precipitation event that caused the <br />erosion. <br /> <br />There shall be no stockpiling of graded materials, other than the topsoil on a temporary basis, <br />allowed within the boundaries of the Subject Property. <br /> <br />The permit holder shall file with the City a liability insurance policy or certificate of such <br />insurance acceptable to the City and issued by an insurance company authorized to do business <br />in the State of Minnesota. <br /> <br />a. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one <br /> person and $500,000 for one accident, and at least $1,100,000 property damage. <br /> <br /> <br />
