Councilmember introduced the following resolution and moved for its adoption: RESOLUTION g97-02- A RESOLUTION ADOPTING FINDING OF FACT # REQUEST FROM ERIC THOMSEN FOR A CONDITI NO-"N-~L GRADE AND EXPORTS SOILS RELATING TO A USE PERMIT TO WHEREAS, the City of Ramsey received an application from Eric Thomsen for a conditional use permit to grade and export excess soils from the property legally described as follows: That part of the Southwest Quarter of the Southwest Quarter of Section 2,Township 32, Range 25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, subject to easement of record; The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying southerly of County Road #63. (the "Subject Property") NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request are determined to be as follows: That on January 4, 1997, Eric Thomsen, hereinafter referred to as "Applicant", properly applied for a conditional use permit to grade and export excess soils from the Subject Property. That the applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.04 of the City Code on February 4, 1997, and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part of these findings by reference. That the Applicant has submitted a grading plan dated January I4, 1997, prepared by E.G. Rud & Sons, Inc. 4. That the Applicant is proposing to export approximately 200,000 yards of earth material. That the Applicant has stated that the proposed haul route for incoming and outgoing trucks will be from the site directly north for a distance of 1,200 feet to County Road #63. 6. That no fill materials, except topsoil for restoration, are proposed to be imported to the site. 7. That no blasting will be employed in the grading activity. That the existing drainage patterns will not be substantially altered by the proposed grading plan. 9. That the grading plan proposes to install silt fence around the perimeter of Wetland.
