Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that <br />City Council approve the issuance of an amended conditional use permit to Bury and Carlson, Inc. <br />to eliminate the restriction on hours of operation, eliminate the requirement for weekly sweeping of <br />t43rd Avenue and Jaspar Street, and increase stockpile heights to 35 feet. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />Terry, and Thorud. Voting No: None. Absent: Commissioner Holland. <br /> <br />Case #3: <br /> <br />Request for an Interim Use Permit for a Temporary Structure; Case <br />of Amcor Precast <br /> <br />Zoning Administrator Frolik advised that Amcor Precast, a division of Oldcastle Precast, Inc., has <br />submitted an application for an interim use permit (IUP) to place a 1,440 square foot modular <br />office structure at 6640 Industry Avenue N.W. for a term of 3 years. Amcor is currently leasing a <br />portion of this property from Royal Concrete, and they will be taking this time to assess their <br />building space needs and develop a plan for permanent occupancy at this address. Ms. Frolik <br />reported that the City has granted similar IUPs for terms of 1 to 3 years, the closest similarity being <br />Listul Industries who received a 1 year permit with a 1 year extension. Staff recommends a <br />compromise of granting the permit for an 18-month period. <br /> <br />Commissioner Deemer advised that he has looked at this location and the building will not be <br />visible from the road. He stated he would be in favor of granting a term longer than what Staff <br />recommends but adding a requirement that the site plan process must be started by April 1998. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Terry to accept #1 through <br />as presented. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, <br />LaDue, and Thom& Voting No: None. Absent: Commissioner Holland. <br /> <br />Motion by Commissioner Thorud and seconded by Commissioner Deemer to amend gl0 through <br />#15 in the affirmative. <br /> <br />Further Discussion: Commissioner Hendriksen, referencing #10, suggested that this represents an <br />increase in business and therefore an increase traffic. Commissioner Deemer stated that they are <br />looking for an increase in business so they have a reason to expand. Commissioner Thorud felt <br />that the building is not bringing an increase in Iraffic, the business itself is doing that. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Thorud, Deemer, LaDue, and <br />Terry. Voting No: Commissioner Hendriksen. Absent: Commissioner Holland. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that <br />City Council adopt the amended Findings of Fact relating to a request for an interim use permit <br />from Amcor Precast for a temporary structure. <br /> <br />Motion carried.
