Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that City Council approve the issuance of an amended conditional use permit to Bury and Carlson, Inc. to eliminate the restriction on hours of operation, eliminate the requirement for weekly sweeping of t43rd Avenue and Jaspar Street, and increase stockpile heights to 35 feet. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, Terry, and Thorud. Voting No: None. Absent: Commissioner Holland. Case #3: Request for an Interim Use Permit for a Temporary Structure; Case of Amcor Precast Zoning Administrator Frolik advised that Amcor Precast, a division of Oldcastle Precast, Inc., has submitted an application for an interim use permit (IUP) to place a 1,440 square foot modular office structure at 6640 Industry Avenue N.W. for a term of 3 years. Amcor is currently leasing a portion of this property from Royal Concrete, and they will be taking this time to assess their building space needs and develop a plan for permanent occupancy at this address. Ms. Frolik reported that the City has granted similar IUPs for terms of 1 to 3 years, the closest similarity being Listul Industries who received a 1 year permit with a 1 year extension. Staff recommends a compromise of granting the permit for an 18-month period. Commissioner Deemer advised that he has looked at this location and the building will not be visible from the road. He stated he would be in favor of granting a term longer than what Staff recommends but adding a requirement that the site plan process must be started by April 1998. The Planning Commission proceeded to review the Findings of Fact. Motion by Commissioner Deemer and seconded by Commissioner Terry to accept #1 through as presented. Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Terry, Hendriksen, LaDue, and Thom& Voting No: None. Absent: Commissioner Holland. Motion by Commissioner Thorud and seconded by Commissioner Deemer to amend gl0 through #15 in the affirmative. Further Discussion: Commissioner Hendriksen, referencing #10, suggested that this represents an increase in business and therefore an increase traffic. Commissioner Deemer stated that they are looking for an increase in business so they have a reason to expand. Commissioner Thorud felt that the building is not bringing an increase in Iraffic, the business itself is doing that. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Thorud, Deemer, LaDue, and Terry. Voting No: Commissioner Hendriksen. Absent: Commissioner Holland. Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that City Council adopt the amended Findings of Fact relating to a request for an interim use permit from Amcor Precast for a temporary structure. Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, Terry, and Thom& Voting No: None. Absent: CommissionerHoIland. Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that City Council approve the request for an interim use permit from Amcor Precast for a temporary structure based on positive Findings of Fact.
