Further Discussion: Commissioner Deemer inquired about the time frame, suggesting a term of 2- <br />1/2 years with a requirement that they must then proceed with the site plan process or withdraw the <br />building within 30 days. Commissioner Hendriksen felt that 1-1/2 years is sufficient time, stating <br />the City must guard against setting a precedent from people moving structures into the city and <br />making them permanent. Commissioner LaDue felt the termination date should be left as is and he <br />saw no reason why they couldn't ask for an extension if need be, stating that "these are business <br />people, and I don't think we need to tell them what they need to do to stay in business." <br />Commissioner Deemer inquired if this location was in a TIF District, and Ms. Frolik replied that k <br />was not. <br /> <br />Motion carried.: Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />Terry, and Thorud. Voting No: None. Absent: Commissioner Holland. <br /> <br />Case //4: Request for a Conditional Use Permit to Grade, Import and Export <br /> Soils; Case of North Fork, Inc. <br /> <br />Zoning Administrator Frolik reported that the City of Ramsey has received an application from <br />North Fork, Inc. for a conditional use permit (CUP) to grade, import and export soils in Northfork <br />5th Addition. The revised grading plan submitted varies from the approved original in order to <br />create the mom attractive walkout style home sites. It also reflects an intent to export <br />approximately 820,000 yards of sand from the 80 acre site, 2/3 of which is associated with the <br />excavation of the second lake, and import 70,000 yards of topsoil and clean organic material. <br /> <br />Dennis Peck, Director of Development for North Fork, Inc., pointed out that with the amount of <br />excavating they are doing at Northfork they may not need to import anything or they may need to <br />import more than the 70,000 yards. He added that they are identifying areas on the golf course for <br />berming areas also. He advised that it is unknown how long this will take, however, the City only <br />allows three-year permits. He stated he would hate to come back for an extension in three years to <br />find a new Planning Commission who is not in agreement with what North Fork is trying to <br />accomplish. <br /> <br />Commissioner Hendriksen inquired as to what language Mr. Peck would like to see added to the <br />permit to give him the assurance that he needs. <br /> <br />Mr. Peck again stated it was his understanding that City Code does not allow more than a three- <br />year permit, therefore he would like this Planning Commission to go on record asserting that they <br />are aware that this may take more than three years and that they approve an extension if it cannot be <br />accomplished within three years. <br /> <br />Commissioner Decor commented that in the past when North Fork, Inc. has requested similar <br />permits, residents have expressed concern regarding dust control from the hauling trucks. <br /> <br />Mr. Peck responded that they could do inspections for dust and water down the roads, etc. <br /> <br />Commissioner Deemer suggested possibly installing a temporary pavement from the eastern edge <br />of the golf course over to Jarvis Street to use as a haul road, thereby limiting dust. He noted it <br />would be easier for these 60-foot long trucks to exit eastbound on Highway gl0 at Jarvis. <br /> <br />Mr. Peck reported that everything they have exported thus far this year has gone to Elk River <br />(west). <br /> <br />Commissioner Deemer reiterated that the site line is better for crossing Highway #10 at Jarvis, so <br />this would address that safety concern. <br /> <br />Planning Commission/November 9, 1995 <br /> Page 5 of 12 <br /> <br /> <br />
