accordance with CITY standards and may be called upon at the CITY'S discretion <br />during said one (1) year period if the CITY deems it necessary to repair and/or <br />replace any of the Stage I Improvements. Said financial guarantee shall be in the <br />form of a Letter of Credit, approved as to form by the CITY. <br /> <br /> II. <br />STAGE H IMPROVEMENTS <br /> <br />12. <br /> <br />Street Cleaning. From lime to time, the CITY may remove accumulations of <br />soil, earth and debris from the streets resulting from the construction of the Plat. It <br />shall be the DEVELOPER'S responsibility to pay the costs associated with this <br />necessary street cleaning. Invoices from the CITY to DEVELOPER for such <br />costs shall be paid within fifteen (15) days of the date of invoice. <br /> <br />13. <br /> <br />Street/Tr~lffig Signs and S¢91 Coating. The CITY will install in the Plat as <br />Stage II Improvements, street/traffic signs and street seal coating. The <br />DEVELOPER will pay to the CITY an amount equal to 100% of the City <br />Engineer's estimated construction cost of the items prior to recording of the final <br />plat. The cost of these items is as follows: <br /> <br />Street Cleaning <br />Sealcoafing <br />One (1) Street Sign <br />One (1) Traffic Sign <br /> <br /> $300.00 <br />$3,050.OO <br /> $120.00 <br /> $120.00 <br /> <br />Total $3,590.00 <br /> <br /> III. <br />PERMITS AND OCCUPANCY: <br /> <br />14. <br /> <br />II~eo_uirements for Building and Occupancy Permits. No building permit <br />for any lot in the Plat shall be issued until: (a) reasonable vehicular access to the lot <br />is provided; (b) a Certificate of Survey, including that information required by the <br />CITY, has been supplied to the City Building Official; and (c) all the financial <br />guarantees required by the CITY have been satisfied. No occupancy permit shall <br />be issued for any lot in the plat until: (a) vehicular access to the permitted lot is <br />provided including the installation of Class V material on all streets in the Plat; and <br />(b) all utilities affecting said permitted 191~ axe in place, operational and accepted by <br />the CITY. <br /> <br />F~.uruhe. nnore, during the installation and for a period of 12 months following <br />acceptance by the CITY, any damage to the Improvements shall be repaired at the <br />~:~st of the DEVELOPER if the CITY is unable to otherwise identify the source <br />of the damage. <br /> <br /> IV. <br />PARK DEDICATION: <br /> <br />15. <br /> <br />Park De0ication. In accordance with the May 9, 1989 Northfork Park <br />Dedication Agreement, there is no park dedication due on the Plat. However, the <br />DEVELOPER herein agrees to m0ke a good faith effort to resolve with the <br />CITY, boundary issues of Lake Itasca Park in order to construct the trail and <br />develop the Park in 1996. Furthermore, the DEVELOPER agrees to construct a <br />nine (9) foot wide trail from Andrie Court N.W., east and north to the existing trail <br /> <br /> <br />
