Except for that segment of wail running south off the <br />cul-de-sac bubble of Andrie Court N.W. and west to 153rd Avenue N.W., the <br />CITY shall reimburse the DEVELOPER for all construction costs beyond <br />grading. <br /> <br /> Ve <br />GENERAL <br /> <br />Transnortation Imoact Fees. The CITY has determined that it is appropriate <br />to implement a transportation impact fee on new development that would not exce~ <br />Five Hundred Dollars ($500.00) per lot. If that fee system is enacted by April 15, <br />1996, the DEVELOPER herein agrees that this Plat shall be subject to said fee. <br /> <br />Transgortation Trails. The DEVELOPER herein agrees to provide a nine (9) <br />foot wide paved transportation trail south from Andrie Court N.W. and west to <br />153rd Avenue N.W. The DEVELOPER will not be reimbursed for trail <br />construction described in this paragraph. <br /> <br />Tree Preservation and Planting Plan. In accordane with City Code and the <br />policy established by the City of Ramsey Park and Recreation Commission on June <br />10, 1993, the DEVELOPER is required to submit a Landscape Plan for CITY <br />approval that identifies existing tree growth within the Plat that will be removed <br />and/or preserved during construction and new plantings. It is herein agreed that the <br />requirement for a Landscape Plan shall be fulfilled by the DEVELOPER as <br />follows: <br /> <br />Minimizing the impact of construction on trees in accordance with <br />Minnesota Extension Service publication "Protecting Trees From <br />Construction Damage" (Publication #NR-FO-6135-S). <br /> <br />Planting one two-inch diameter tree (or equivalent thereof) of an approved <br />species at the road frontage or in the front yard of each of the lots in the Plat <br />prior to issuance of a Certificate of Occupancy. In the event the weather is <br />not conducive to tree or sod planting at the time of Certificate of Occupancy, <br />the Building Permitholder shall place a cash deposit in the amont of $200.00 <br />for trees in an escrow account with the crrY and upon verification of the <br />planting being accomplished, said cash deposit shall be refunded to the <br />Builder Permit Holder. Failure of the Builder to comply with the planting <br />requirement within a reasonable time frame following a determination by the <br />CITY that weather conditions are conducive to planting shall give the CITY <br />the authority to cause the planting, the cost of which shall be charged to the <br />escrow account and the builder shall not be eligible for a refund of the cash <br />deposit made for this purpose. <br /> <br />Tree Disease Prevention and Disposal. The DEVELOPER shall prevent the <br />introduction and spread of tree disease into the residual tree populations of the Plat <br />and adjoining properties and reduce the impacts of consmacfion on the residual <br />property of the Plat and adjoining properties. The DEVELOPER in order to <br />accomplish this shall: <br /> <br />Install physical barriers, such as snow fence, around trees that are to <br />remain. The fencing shall be located at the dripline of these remaining trees. <br /> <br />b. Insure. II, at all equipment operators will have readily available, a tree wound <br /> <br /> <br />
